As of now Broward and Miami-Dade counties are allowed to have slot machines in gaming facilities. The compact between the Seminole Tribe and Florida gives exclusive gaming rights to the tribe outside of the Miami area.

However, Gretna Racing LLC believes horse racing tracks should also be allowed to operate slot machines in their casinos and card rooms. The company believes this should be allowed due to a statute that was passed by state Legislature in 2010.

Since 2003 Broward and Miami-Dade counties have been allowed to operate slot machines as long as the gaming venues have pari-mutuel betting.

However, Miami-Dade's Hialeah Park was granted permission by state lawmakers to operate slot machines. The casino has a Class III gaming license.

It is from this ruling that Gretna is pushing for a change in Florida's gaming law. The company has developed a casino and wishes to operate slot machines. The Poarch Band of Creek Indians has partnered with the company on the casino.

Oral arguments were heard on June 7 at the Florida Supreme Court. However it unknown when a decision will be made by the court.
