OKLAHOMA CITY, Okla. - Sept. 8, 2026 - Oklahoma tribal leaders are intensifying their opposition to prediction markets, arguing that platforms such as Kalshi threaten tribal sovereignty, undermine established tribal gaming regulations and create new challenges for the Indian Gaming Regulatory Act (IGRA).
The debate over prediction markets and sports event contracts has become a growing concern among tribes across Oklahoma as federal regulators, courts and lawmakers weigh how these products should be classified and regulated. Tribal leaders argue that these platforms closely resemble sports betting and should not be allowed to circumvent long-standing tribal gaming laws.

During a recent gathering of the United Indian Nations of Oklahoma, representatives from 20 tribal nations discussed the rise of prediction market operators and their potential impact on tribal gaming operations throughout Indian Country.
Oklahoma Indian Gaming Association Chairman Matthew Morgan has become one of the most outspoken critics of prediction markets, citing concerns that the products conflict with IGRA and longstanding tribal gaming frameworks.
"They look at tribes and tribal gaming and they think we're standing in their way. And so they've decided to use their political muscle in order to try to shove us out of the way. They're going to disregard precedent that has been set for decades on how these things are handled and just say, 'We don't need your permission.'"

Morgan argues that prediction market companies are attempting to classify sports-based contracts as financial products regulated by the Commodity Futures Trading Commission (CFTC) rather than gambling activities governed by state and tribal gaming authorities.
Kalshi and Sports Event Contracts Face Tribal Scrutiny
The controversy largely centers on Kalshi and similar operators that offer sports event contracts tied to sporting outcomes. Tribal leaders contend these offerings function as sports wagers and should be regulated under existing gaming laws.

According to tribal leaders, prediction markets represent one of the most significant emerging challenges facing tribal gaming regulators, tribal casinos and gaming compacts across the United States.
Consumer Protection Remains a Key Concern
In addition to sovereignty issues, Oklahoma tribal leaders have highlighted concerns surrounding consumer protections, game integrity and regulatory oversight.

Morgan noted that tribal casinos operate under strict regulatory requirements that help ensure fairness and accountability for customers, protections that tribal leaders fear may not exist under the prediction market model.
Legal Battles and Federal Regulation Continue
Several tribes in California and New Mexico have challenged Kalshi in court, arguing that sports event contracts constitute gambling and bypass tribal gaming regulations established under IGRA.
Oklahoma Attorney General Gentner Drummond joined attorneys general from more than 40 states in urging regulators to view the contracts as gambling products rather than financial instruments.
Morgan also praised a recent federal court ruling that he said reinforced the ability of states and tribal governments to enforce gaming laws.
"I thought the 9th Circuit ruling was really good in that they recognized that the sports betting platform providers could not utilize the Commodities Exchange Act in order to circumvent state and tribal laws. So, that was a win for Indian Country."

Oklahoma Tribal Leaders Promise Continued Opposition
As discussions continue in Congress, the courts and before federal regulators, Oklahoma tribes say they will remain actively engaged in defending tribal sovereignty, tribal gaming rights and the integrity of the Indian Gaming Regulatory Act.
