The New Mexico Supreme Court issued a ruling this week regarding the jurisdiction of tribal courts over personal injury and damage cases. Henceforth, all such lawsuits against Native American casinos in New Mexico must all be processed through tribal courts rather than through state courts.
The ruling ends years of controversy over jurisdictional authority on tribal lands.
"We've been fighting state court jurisdiction over these cases for 20 years and so it's the end of a long struggle to keep state courts out of determining tribal affairs."
- Attorney Richard Hughes, Tribal Representative
The Supreme Court ruling came from a request by the Pojoaque Pueblo to address the jurisdiction issue in a 2016 case under review about personal injury incurred by a vendor employee making a delivery to a tribal casino. The Court sided with the Tribe and recognized the legal sovereignty of tribal lands that have been transferred into federal trust for tribal governance.

The Navajo Nation has permanently banned indoor smoking at its tribal casinos. A temporary ban has been in place to combat the spread of COVID-19. However, Saturday the ban became permanent when Navajo President Nez signed tribal legislation prohibiting the indoor use of cigarettes, electronic cigarettes, cigars, chewing tobacco, and other products.
The smoking ban applies to all public buildings and workspaces in addition to the four Navajo casino. The ban excludes the use of tobacco in ceremonies and in private homes.

New Mexico's 14 tribes report their adjusted net win amounts from casino operations to the New Mexico Gaming Control Board every quarter, and the Board posts a summary of the payents on its website .
"Adjusted Net Win" is not the net profit. It is the amount played on slot machines, less the amount paid out, less regulatory fees.
The quarterly net-win reports give a relative comparison of which Indian gaming casinos generate the most income. The followings two lists rank the New Mexico tribes by the amount of net-wins reported in 2020 and 2021.

Under the initial reopening guidelines, the Navajo casinos will only be open to Navajo members and employees. New operating hours are limited to 6 AM to 8 PM and guest capacity is limited to 25 percent.
All employees have been tested for COVID-19 and trained in safety procedures. New equipment has been added to each casino for social distancing of guests and workers.

A new bill for the New Mexico legislature would expand casino gaming to full Vegas-style casinos at the five racetracks across the state.
If passed, New Mexico's racetrack casinos (racinos) could expand with new slot machines, craps, roulette, live poker and a full sportsbook. Currently these racinos offer sports betting on horse racing only along with limited slot machines, video poker, blackjack and roulette.
The new casinos would be regulated by the New Mexico Lottery, and the tax revenues paid to the state by the casinos is estimated to bring $40 million a year with $15 million allocated to the Lottery Scholarship Fund, a college scholarship fund.

The Navajo Nation will not reopen its casinos this month, and no plans for September have been announced.
The shutdown is causing extreme financial stress on the Navajo Nation and forced the layoff 88% of the casino workers earlier this month.
Although other tribal casinos have reopened across Arizona and New Mexico, Navajo Nation Gaming Chairman, Quincy Natay, says:
"As the first tribal casino to close on March 17th, and possibly the last to reopen, Navajo Nation Gaming will offer 'best-in-class' safety measures and a 'trusted-space' environment for our patrons and team members when it is safe to reopen."
Navajo Nation Gaming operates three casinos in New Mexico and one in Arizona:

The Laguna Pueblo already owns two casinos, restaurants, hotels, and gas stations. Now they are looking into developing a new business that will not be located on their land.
It would be located near Clovis in Curry County. The project would be a race track and casino. This is not the first time the tribe has attempted to expand their gaming industry off of their reservation.
Off reservation gaming has been part of their plans for many years.
In 2011 the tribe made their first attempt to build a racino in Albuquerque at the fairgrounds. The bid for the project was rejected. The surrounding community was also opposed to the project.
In 2016 the tribe then attempted to purchase a riverboat in Lake Charles owned by the Isle of Capri. Over $20 million was lost when the project was not approved.
In ten years, $100 million has been earned from the different businesses owned by the pueblo.
In 2013 records from Tribal Council meetings show the growing concern of revenue from their two casinos and their other businesses becoming stagnant. Dancing Eagle Casino and Route 66 Casino are both owned by the tribe. Expanding their sources of revenue became of interest.
The racino in Curry County is in the beginning development of plans. Applications have not been submitted so far to the New Mexico Racing Commission.
