North Carolina Casinos | 2024 Updates

North Carolina has three operating Indian-gaming casinos and no commercial casinos. Legalized sports betting was signed into law in June 2023 and began in March 2024. Legislation to authorize four new commercial casinos was negotiated in the General Assembly during the 2023 session, but failed to get enough final votes to pass.

Three Indian-gaming Casinos
North Carolina has three Indian-gaming casinos operating in the western part of the state. Two are owned by the Eastern Band of Cherokee Indians of North Carolina. The tribe opened Harrah's Cherokee Casino Resort in 1997 and Harrah's Cherokee Valley River Casino in 2015. The third North Carolina casino is owned by the Catawba Indian Nation, which opened the Catawba Two Kings Casino in 2021. See casinos.

Minimum Gambling Age
The minimum gambling ages in North Carolina are 21 years old for casinos, 21 for poker, all ages for bingo, 21 for sports betting, 18 for horse racing, and 18 for the lottery.

Sports Betting
Sport betting is currently operating in the state's three tribal casinos. Online sports betting will become legal in North Carolina on Jan. 1, 2023. Twelve operator licenses will be issued by the North Carolina Lottery Commission for mobile and online sports betting.

Three casinos in North Carolina operate under the U.S. Indian Gaming Regulatory Act. Each tribe has negotiated a gaming compact with the state to define the types and numbers of casino games to operate and the percentage of gaming revenues to pay to the state.

Casino gambling began in North Carolina 25 years ago with the opening of the first casino in 1997. Since then a timeline of expansion added two more casino. All three casinos are Indian gaming casinos regulated by the National Indian Gaming Commission.

What gambling changes will North Carolina see in 2024? There are two almost certainties coming: sports betting will launch by mid-2024 and talk of casino expansion will return as a hot political issue.

Casino Expansion
North Carolina failed to pass a casino bill this year that would have authorized four new casinos, one each in Anson, Nash, and Rockingham counties, and a Lumbee tribal casino.

House Speaker Tim Moore says the casino push will continue in 2024.

Sports BettingThe new Sports Wagering and Horse Racing Wagering was signed into law by Gov. Roy Cooper on June 14, 2023 and will become operational by mid-2024. The law authorizes eight retail sportsbooks and 12 online sportsbooks. Each will be licensed and regulated by the North Carolina State Lottery Commission.

Currently, retail sportsbooks are operating only at three tribal casinos in the state. Caesars sportsbooks were opened at Harrah's Cherokee Casino Resort in Cherokee and Harrah's Cherokee Valley River in May 2021. The third sportsbook opened at Catawba Two Kings Casino in Kings Mountain in September 2022.

The new retail sportsbooks will accept bets from anyone 21 or older, who wants to bet on professional and college sports. These sportsbooks will be located within 1.5 miles of any of the eight NC professional sports facilities.

North Carolina Casinos Dropped from Budget Bill

September 21, 2023

The North Carolina General Assembly will vote on Thursday and Friday on a clean budget resolution, which no longer includes casinos. Medicare expansion will also be included in the budget after Gov. Roy Cooper strongly rejected a plan to link casinos and Medicare together in a new bill.

House Speaker Tim Moore and Senate leader Phil Berger held a news conference Tuesday night to announce the casinos were removed from the budget bill.

"Clearly, there were differences of opinion, and at the end of the day, we felt like this issue, and no single issue should hold up a budget."

The next few days will determine whether a North Carolina casino expansion bill is dead for now or will still be considered in this legislative session.

North Carolina Senate Unveils New 'Standalone' Casino Bill

September 20, 2023

North Carolina Senate President Pro Tempore, Phil Berger, says the casino provisions in the current budget bill will be replaced by a new standalone casino bill to be introduced in the next few days. This action is expected to free up the $30 million budget for passage, and still allow the casino plan to continue negotiations in the legislature.

The new bill will authorize four new casinos in North Carolina to "encourage and promote tourism in rural counties". These are the terms:

• Three casino licenses would be assigned to "rural counties on the state border and along major transportation corridors." No locations are mentioned, including the previous counties of Anson, Nash, and Rockingham where residents have fought against the previous plan.

• A fourth license would be assigned to the Lumbee Tribe of North Carolina for a state-regulated casino, in lieu of a federal Indian-gaming casino.

• The new bill will open the bidding to multiple casino operators at each of the three county locations. The previous bill specified only one operator for all three casinos.

• Casino applications will require approval by city officials and local residents before submission to the Secretary of Administration.

Meanwhile Speaker Tim Moore said the House will vote Wednesday on the state budget without the casino provisions. A separate casino bill will be voted on, which will be tied to Medicaid expansion.

North Carolina currently has only three casinos. All are owned by Native American tribes and regulated by the federal government. The Eastern Band of Cherokee own Harrah's Cherokee Casino Resort in Cherokee, NC, and Harrah's Cherokee Valley River Casino in Murphy, NC. House Speaker, Tim Moore, says his party lacks enough support for the casino provisions. A clean budget bill without casinos will be introduced into the House this week. A vote is expected soon afterwards.

North Carolina casino vote aimed at mid-September

September 6, 2023

This week will be a very key in determining whether the North Carolina legislature proceeds with a vote to add four new casinos to the state. Republican lawmakers will hold a closed door meeting this week to count the support for adding the casino proposal to the state budget.

If the republicans have enough support for the casino plan, they will move for voting during the second week of September.

Before that happens, House republicans will hold another closed door meeting next week to discuss whether the casino provisions should be opened to the public and inputs gathered from all parts of the state. They will also discuss rather the casinos should be voted on separately.

North Carolina Casino Proposal Opposition

August 22, 2023

The proposal to allow four new casinos in North Carolina is under discussion in a conference committee of state representatives and senators, who are finalizing details of the 2023 Appropriations Act. Lawmakers are debating and drafting language for inserting casinos into the bill. Although the fiscal year began July 1, the budget bill will not take effect until September.

In the meantime opposition to the casino plan is growing in several sectors of the state.

County Residents Opposition
Many residents in Anson, Nash, and Rockingham counties have expressed opposition of casinos to county officials at public meetings.

Catawba Nation Opposition
The Catawba Nation met with state legislators last week to express opposition to the casino plan. The tribe's goal was "gaining support against the commercial casino bill that is being proposed."

Commercial Casino Opposition
Several commercial casino companies want the language changed in the legislation. The draft bill favors one company, Cordish Cos., to own all three county casinos with an investment of $1.5 billion and a 22.5% tax on gross gaming revenue. The draft bill defines owner qualifications that essentially eliminate Cordish competitors.

Summary
Unless there are significant changes to the casino legislation, the House is not expected to pass it according to recent industry and media sources.

North Carolina Casinos: Draft Bill

The North Carolina state legislature is discussing a draft bill or a budget resolution to legalize four casinos. Three casinos would be built in the counties of Anson, Nash and Rockingham and a fourth casino would be built by the Lumbee Tribe on reservation land.

No casino bill has yet been introduced in the legislature; however, a draft bill and a budget resolution are both under discussion. Both are supported by House Speaker Tim Moore (R-Cleveland) and President Pro Tem of the Senate Sen. Phil Berger (R-Rockingham).

The discussions to expand North Carolina casinos began last month with a draft bill entitled "Rural Tourism Incentive Program".

RURAL TOURISM INCENTIVE PROGRAM

"The purpose to encourage and promote tourism in rural counties on the State border and along major transportation corridors. The program will allow for gaming, which is a new and expanding component of the tourism industry and is currently allowed in North Carolina on certain Indian lands. As many contiguous states allow gamin, those industry business opportunities and employment opportunities are being lost to this state."

Under the terms of the draft bill, the casinos in Anson, Nash and Rockingham counties would each require a minimum investment of $500 million and the creation of a minimum 1,750 new jobs.

Casino applicants would submit proposals to the Secretary of Commerce by September 1, 2023 along with a submission fee of $25 million. Casino licensing would be managed by the North Carolina Lottery Commission.

North Carolina will collect an excise tax of 22.5% on gross gaming revenues. Five percent of the net tax proceeds will go to the county. Five percent of the net tax proceeds will be split on a per-capita basis with counties that are tier 1 development areas. North Carolina casino expansion supported by nearly half of residents

As North Carolina legislative leaders consider introducing a bill for four casinos in the state, a new poll released Wednesday finds that nearly half of state residents support the idea. The survey of 1,000 people found 45% would support the plan, 29% are opposed, and 26% are undecided. A majority 58% believe the casinos would be a financial benefit to the state.

Although a final bill to expand casinos has not been released, lawmakers are discussing a plan to authorize a total of four casinos in Nash, Anson and Rockingham counties and the reservation land of the Lumbee Tribe.

North Carolina currently prohibits commercial casinos. However, there are three tribal casinos in the state: Harrah's Cherokee Casino Resort in Cherokee, Harrah's Cherokee Valley River Hotel & Casino in Murphy, and Catawba Two Kings Casino Resort in Kings Mountain.

NC Draft Casino Bill

The draft casino bill under discussion is dated July 11. It authorizes casinos in three counties that meet these prerequisites:

• Location east of Interstate 77
• County is a border county or a county traversed by Interstate 95
• County population must be less than 100,000 people
• County must be one of the 40 most economically depressed in the state

Three counties with these criteria are identified and authorized by the draft casino bill:

• Anson County
• Nash County
• Rockingham County

A fourth casino owned by the Lumbee Tribe is also under consideration.

The draft casino bill specifies September 1 as the start date for submitting casino proposals to the secretary of administration. The proposal must commit to a minimum $1.5 billion investment and 5,250 employees. The applicant must have a minimum of ten years in the casino business

North Carolina approves online sports betting

Online sports and horserace betting are coming to North Carolina after final legislation was passed by the General assembly last Wednesday. Gov. Roy Cooper says he will sign it into law this week.

Sports betting and horse racing will be controlled statewide by the North Carolina Lottery Commission. Wagering provisions include the following:

• North Carolina sports wagering and horse racing will start in January 2024.

• Players must be 21 years or older to bet.

• A sports wagering tax of 18% will be collected on gross betting receipts. Revenues will be distributed to problem gambling programs, youth sports programs, and college athletic departments.

• A maximum of 14 sports betting operating licenses will be issued at $1 million each for five years. This includes two tribal online licenses for the Eastern Band of Cherokee Indians and Catawba Indian Nation.

U.S. House votes for full recognition of Lumbee Tribe of North Carolina

November 9, 2021

On the first day of Native American Heritage Month the U.S. House of Representatives passed H.R.2758 titled "Lumbee Recognition Act". The bill would grant full federal recognition to the tribe with federal benefits and services to its members.

As a recognized tribe, the Lumbee could someday apply to the U.S. Department of Interior for the right to operate a casino on its reservation in accordance with the U.S. Indian Gaming Regulatory Act.

The House bill passed by a 357-59 vote and has been sent to the Senate for consideration.

North Carolina Senate passes sports betting bill

August 27, 2021

The North Carolina Senate passed Bill 688 last week by a vote of 26-19. If passed by the House and signed by the governor, the legislation would authorize twelve more sports betting licenses including mobile betting and professional sports stadiums.

Currently sport bets can only be placed at two locations in Norh Carolina: Harrah's Cherokee Casino Resort in Cherokee and Harrah's Cherokee Valley River Hotel & Casino in Murphy.

The Senate bill has now been sent it to the House, where it had a formal reading last week and was assigned to the House Committee on Rules, Calendar, and Operations. There has been no indication at this time how long it will be before the committee votes on the bill.
